Terms of Service

1. Eligibility & Age Requirement

You must be at least 18 years old to create an account or access the Platform. By registering, you represent and warrant that you are 18 or older and that you have the legal capacity to enter into this agreement. FunVertex reserves the right to request government-issued identification at any time to verify age or identity, and to suspend an account pending verification.

2. Accounts

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must provide accurate registration information and keep it up to date. One person may not maintain more than one Fan account, and Creator accounts are subject to identity verification before payouts are enabled.

3. Creator Content

Creators retain ownership of the content they upload ("Creator Content"). By posting Creator Content, you grant FunVertex a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display that content solely as necessary to operate the Platform (including generating blurred previews and applying an attribution watermark to uploaded photos). You represent that you own or have all necessary rights to the content you upload, and that it does not infringe any third party's rights.

Creators are solely responsible for ensuring their content complies with applicable law, including age-verification and record-keeping requirements (such as 18 U.S.C. §2257 where applicable) for any performers depicted in their content. See our 18 U.S.C. §2257 Compliance Statement.

Content and likeness consent. Before a Creator can upload any content, they must give a separate, express consent — with its own checkbox, distinct from accepting these Terms and the Creator Agreement — that their content, including their images and likeness, will be used and displayed publicly on the FunVertex website. A record of that consent is kept with the Creator's acceptance of the Creator Agreement.

4. Pre-Screening of User-Uploaded Content

All user-uploaded content is reviewed before it is published, to make sure it is not illegal and does not otherwise violate these Terms or the Content Policy:

• Posts and pay-per-view media are held back from every public and subscriber-facing view until they have passed screening. Photos are checked directly; videos are checked across several frames.
• Message attachments (direct and mass messages) are screened before they are delivered, and profile and cover images before they are displayed.
• Every upload is checked by our own automated systems — face detection, age estimation and image classifiers — for anyone who may be under 18. An upload is rejected when these systems agree that a child is shown, and is held for review by a person whenever they cannot be certain.
• Content that fails screening is rejected or removed and is never published. If screening cannot be completed, the upload is held or refused rather than published unscreened.
• A trained human moderation team reviews flagged and reported content, and serious categories are escalated immediately.

Passing screening does not make content compliant: Creators remain responsible for everything they upload, and content that later proves to violate these Terms is removed. The screening process is described in full in Part B of the Content Policy.

5. Payments, Wallet & Subscriptions

Fans pay for subscriptions, gifts and pay-per-view unlocks either from an in-platform wallet balance they fund via our payment processor, or directly by card through our payment processor — the choice is made at each payment. A card you pay with is saved by our payment processor (we never see or store the card number) so later payments can be made in one click, without entering it again; only your most recently used card is kept, and you can remove it at any time from your wallet. A subscription runs for a 30-day term, or for a longer term the Creator offers (3, 6 or 12 months) at the discounted price shown, paid in full at the start of the term. A paid subscription renews automatically, as stated before you pay: at the end of each term, for one more term, at the price shown when you subscribed (never more), until you turn renewal off. A subscription paid by card is a recurring subscription with our payment processor, which charges the same card at the start of each term; one paid from your wallet renews from your saved card (your most recently saved card) and, if you have none or it cannot be charged, from your wallet balance. If a renewal charge to your card is declined, our payment processor may try it again, and if your wallet balance covers the term it is paid from your wallet instead and the card is not charged for it. If nothing can pay, the subscription ends. If the Creator lowers the price, your subscription renews at the lower price; if they raise it, your subscription ends with the term you paid for unless you agree to the new price. A free trial does not renew. We email you before each renewal. You can turn renewal off at any time from your Subscriptions page, or through our payment processor, and keep access until the term you paid for expires. Once turned off, renewal can't be turned back on for that term; you can subscribe again after it ends. Creators earn a share of revenue generated from their content, subject to the platform fee disclosed in your Creator dashboard, and may request payout to a connected bank account once identity verification is complete.

Because digital content is delivered immediately upon unlock, purchases are generally non-refundable — but there are defined exceptions (unauthorised charges, duplicate charges, non-delivery, content materially not as described), and a process for requesting a refund and for disputing a charge. These are set out in full in the Refund & Chargeback Policy, which forms part of these Terms.

6. Prohibited Content & Conduct

The full list of what is not permitted on the Platform, together with how content is screened, reported, enforced and appealed, is set out in the Prohibited Content & Content Moderation Policy, which forms part of these Terms. In summary, you may not use the Platform to upload, send, or solicit:

• Content depicting anyone under the age of 18, however produced or depicted.
• Non-consensual content, or content depicting real people without their consent.
• Content involving violence, bestiality, or content illegal in the jurisdictions FunVertex operates in.
• Harassment, hate speech, or threats directed at another user.
• Impersonation of another person or entity, or fraudulent payment activity.
• Malware, unauthorized scraping, or attempts to circumvent paywall or watermarking protections.

Violations may result in content removal, account suspension, or permanent termination, and may be reported to law enforcement where required.

7. Human Trafficking

FunVertex does not condone human sex trafficking in any form. All instances of suspected human trafficking will be reported to the proper authorities. Any account involved in, advertising, or facilitating trafficking, sexual exploitation, or coercion is terminated. If you suspect trafficking, report it through the in-app report control or the Support Center; in an emergency, contact your local law enforcement.

8. Reporting, Complaints & Blocking

Users can report content or accounts for review, and may block another account to prevent messaging, following, subscribing, or viewing each other's profile. FunVertex reviews reports and may take action including content removal or account suspension.

Complaints can be sent to [email protected] or through the Support Center. All complaints are reviewed and resolved within five (5) business days of receipt, and the outcome is communicated to the complainant. Appeals of a decision can be sent to [email protected] and are likewise decided within five (5) business days.

9. Termination

You may deactivate your account at any time from Settings. We may suspend or terminate your access to the Platform, with or without notice, for violation of these Terms, suspected fraud, or as required by law. Outstanding creator balances at the time of termination for cause may be withheld pending investigation.

10. Disclaimers & Limitation of Liability

The Platform is provided "as is" without warranties of any kind. FunVertex is not responsible for content posted by users. To the maximum extent permitted by law, FunVertex's aggregate liability arising out of your use of the Platform will not exceed the amount you paid us in the twelve months preceding the claim.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified in-app or by email; continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
